ENTRY RULES:
Gresham Station Shopping Center’sWin a Nano iPod Raffle Contest Drawing (“Contest Drawing”)begins on Thursday, June 5, 2008 at 12:01 a.m (Pacific Time) and ends on Tuesday, August 31, 2008 at 11:59 p.m (Pacific Time). You can submit your entry form for the Contest Drawing via entry boxes, available in participating stores throughout Gresham Station shopping center. Any other attempt at entry is void. Incomplete entries, failure to follow the instructions, procedures and/or these Official Rules shall render the entry invalid.
There is a limit of one (1) entry per person during the Contest Drawing. If multiple entries are received from any one person, only the first entry per person will be considered and subsequent entries will be disqualified. All entries must be actually received by Tuesday, August 31, 2008 at 5 p.m (Pacific Time), regardless of the date or time e-mailed or date or time stamp.
WHO CAN JOIN?
Only legal residents of the United States who reside in the State of Oregon and who are 18 years of age or older as of June 5, 2008 are eligible to enter the Contest Drawing and win a prize. Employees, officers, directors (and their immediate family members and members of the same households) and agents and representatives of (i) Westlake Realty Group, Inc (“Sponsor”) or (ii) any of their respective parents, affiliates and subsidiary companies (all of (i), (ii) and shall collectively be deemed “Gresham Station Shopping Center”) and employees, officers, directors, agents and representatives of (a) the merchants of Gresham Station Shopping Center or (b) any advertising or promotion agencies that do business with Gresham Station Shopping Center, are not eligible to win.
PRIZES/ ODDS OF WINNING
Fifteen (15) nano ipod prizes (specs: 4GB MP3) will be awarded to each winner. There are no cash equivalents for prizes. Prizes are nontransferable. Prizes awarded are subject to restrictions and limitations noted in these Official Rules, on the prizes or included with the prizes and each winner must abide by all such limitations and restrictions. Each winner agrees to accept his or her prizes “as is”. There is a limit of one (1) prize per person for any Contest Drawing conducted by Sponsor during 2008. Odds of winning a prize depend on the number of eligible entries received at the time of the applicable drawing.
DRAWING AND NOTIFICATION OF WINNER
Fifteen (15) winners of a nano ipod will be selected in a random drawing to be held on or about August 31, 2008 from all eligible and qualified entries received in accordance with these Official Rules at the time of the applicable drawing. Winners will be notified by phone, e-mail or U.S. mail. If a winner cannot be reached after a reasonable effort has been exerted, or if he/she is found to be ineligible, or if he/she cannot or does not comply with these Official Rules, the winner may be disqualified and an alternate winner may be selected.
GENERAL CONDITIONS
Each winner is solely responsible for all taxes relating to his or her respective prize, including applicable sales and income taxes. Each winner will be required to provide a valid photo identification (e.g., Oregon state driver’s license, U.S. passport) or the winner may be disqualified and an alternate winner may be selected. To the extent applicable, return of prize notification as undeliverable will result in disqualification. Once submitted, entries become the property of the Sponsor and will not be returned. The winner may pick up his or her prize at the Gresham Station Management Office located at 1042 NW Norman Avenue, Gresham Oregon 97030, Monday through Friday 8:00 a.m. - 5:00 p.m.
Except where prohibited by law, by accepting the prize each of the winners grants Gresham Station Shopping Center and their respective partners, designees, licensees, parents, subsidiaries, affiliated, assigns, related companies and successors, and all of their respective officers, directors, employees, representatives and agents (collectively, the “Sponsor Entities”) the universal and perpetual right to use, exploit, print, publish, reproduce, display, distribute and broadcast the winner’s name, actual or simulated likeness, photograph, image, voice, portrait, picture, personal characteristics, biographical information and other personal identification in any and all languages, formats, and media now known and hereafter developed, in connection with the Web Site, Contest Drawing, or any other sweepstakes-related activity and any and all advertising, promotion, marketing, and/or publicity thereof, including all ancillary and subsidiary rights therein, without additional consideration
Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or, as applicable, the operation of the Web Site, or who is otherwise in violation of these Official Rules. Such a person will be prosecuted to the fullest extent of the law. Sponsor further reserves the right to cancel, terminate, suspend or modify any sweepstakes, game or drawing not capable of completion as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention or technical or other failures of any sort, or any other causes beyond the control of the Sponsor.
OFFICIAL RULES
This Contest Drawing is subject to these Official Rules, which will be available on the Web Site during the Contest Drawing period. By entering the Contest Drawing, entrants agree to waive any right to claim any ambiguity or error in the Official Rules of the Contest Drawing, or the Contest Drawing itself, and agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decision is binding and final in all respects.

Sponsor Entities are not responsible for lost, late, damaged, incomplete, stolen, illegible, misdirected, deleted, destroyed or altered entries; or for any mail, computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, errors, interruptions, deletions, delays, connections, availability or garbled or jumbled transmissions, service provider/ Internet/Web Site/ use net accessibility or availability, traffic congestion, or unauthorized human intervention or access to the Web Site, as applicable. Proof of entering information at the Web Site or of deposit into U.S. mail, as applicable, is not considered proof of delivery or receipt. The Sponsor Entities are not responsible for any incorrect or inaccurate information.
By participating, entrants on behalf of themselves or their heirs, executors, administrators, successors assigns hereby knowingly and voluntarily release, discharge, waive and relinquish, and agree that they will not assert or maintain against the Sponsor Entities and those involved in the development, production (including prize suppliers, contractors, service providers), implementation and distribution of this Contest Drawing, all participating merchants and their designated agents and any other person or entity associated with such entities or this Contest Drawing, and any of their respective officers, directors, employees, representatives, attorneys or agents (collectively, “Sponsors’ Companies”) any claim, action, suit or demand of any kind or nature whatsoever, whether known or unknown, now or in the future, directly or indirectly, in whole or in part, arising out of or in connection with their participation in this Contest Drawing or any Contest Drawing-related activity, or their acceptance, possession, use or misuse of any prize in any way (including any tax liabilities). Entrants hereby further agree that Sponsors’ Companies are not responsible or liable for, and that entrants will indemnify, defend, release, and hold Sponsors’ Companies harmless from and against, any and all claims, liabilities, losses, damages, injuries, costs and expenses (including without limitation, reasonable attorney’s fees) of any nature whatsoever, whether known or unknown, now or in the future, directly or indirectly, in whole or in part, arising out of or in connection with their participation in this Contest Drawing or any Contest Drawing-related activity, or their acceptance, possession, use or misuse of any prize in any way (including any tax liabilities). Entrants hereby acknowledge that they may hereafter discover facts different from or in addition to those which they now know or believe to be true and agree that this release will remain effective notwithstanding.
WINNER/RULES:
The names of the winners in the Contest Drawing may be obtained after October 1, 2008 by sending a self-addressed, stamped envelope to Gresham Station Shopping Center Win a Nano Ipod Raffle Contest! Gresham Station Management Office1042 NW Norman Avenue, Gresham, Oregon 97030.
GOVERNING LAW:
Except to the extent preempted by federal or other applicable state law, this Contest Drawing shall be governed by the laws of the State of Oregon (without giving effect to any conflict of law provisions thereof). By participating in this Contest Drawing, entrants agree that any and all disputes which cannot be resolved between entrant and Sponsor, and causes of action arising out of or connected with this promotion, shall be resolved individually and exclusively, without resort to any form of class action, before a court located in the City of Portland, Oregon having competent jurisdiction, which court shall apply the laws of the State of Oregon without giving effect to any conflict of law provision thereof.
